Terms and conditions of AirTeq B.V. for the AirCheq® Canairy web shop
Version 1.0, valid from 11 September 2026. This is a translation of the Dutch terms and conditions; in the event of any discrepancy, the Dutch text prevails (article 19.2).
Article 1. Who we are and what these terms apply to
1.1 These terms apply to every order in the web shop at www.aircheq.com and to every contract arising from it.
1.2 The seller is AirTeq B.V., established at Pascalweg 2a, 4104 BG Culemborg, the Netherlands, registered with the Dutch Chamber of Commerce under number 59625820, VAT number NL853576452B01. You can reach us at support@airteq.eu and +31 (0)345 785 611, on working days from 08:00 to 17:00 (CET). In these terms we call ourselves “AirTeq” or “we”. AirCheq® and Canairy are trademarks of AirTeq B.V.
1.3 By “you” we mean the customer. If you are a consumer, you buy for private use, not for your trade or profession. If you order on behalf of a company or institution, or in the course of a profession, article 17 also applies.
1.4 You can read and save these terms before ordering. We attach them as a pdf to the order confirmation, so you can always find them again. We do not keep the concluded contract separately for you; please keep the confirmation yourself.
1.5 These terms never limit the statutory rights you have as a consumer. If anything in these terms conflicts with mandatory law, the law applies and the rest of the terms remain in force.
Article 2. The offer and the price
2.1 In the web shop we sell the AirCheq® Canairy Home and the AirCheq® Canairy Home Plus. What each device measures and can do is stated on the product page and in the specifications. That description forms part of the contract.
2.2 All prices are in euros and include VAT. The shop shows the price including the VAT of the country we deliver to. Shipping within the Netherlands is free. For delivery to other countries of the European Union we show the shipping costs per country in the shop, before you place the order. There are no other costs.
2.3 Obvious mistakes in the offer, such as a price that is clearly wrong, do not bind us. In that case we let you know immediately and any amount already paid is refunded.
2.4 Price changes do not apply to orders already placed.
2.5 Consumers may buy a maximum of 5 devices per order. For larger quantities and for the business version with Wi-Fi or LoRaWAN we prepare a quote via sales@airteq.eu.
Article 3. Ordering
3.1 You place an order by completing the order form, accepting these terms and clicking the button “Place order with obligation to pay”. By doing so you make an offer to buy.
3.2 The contract is concluded as soon as we confirm your order by email. We send that confirmation, with the invoice and these terms attached, immediately after your payment has been received. If you do not receive a confirmation within 24 hours, check your spam folder and otherwise contact us.
3.3 We may refuse an order or attach additional conditions to it if there is a good reason, for example a delivery address outside our delivery area, a suspicion of misuse or fraud, or if the product is no longer available. We let you know as soon as possible, at the latest within 3 working days, and refund any amount already paid within 14 days.
3.4 You are responsible for entering your details correctly, in particular your email address and the delivery address.
Article 4. Payment
4.1 You pay when placing the order. Payment is made through our payment service provider Mollie B.V. You can choose from the payment methods shown in the web shop, currently iDEAL, credit card (Visa and Mastercard) and Bancontact.
4.2 From Mollie we receive only the confirmation that you have paid and the details needed to link the payment to your order. We do not see or store full payment details.
4.3 If a payment is not completed within 1 hour, the order lapses automatically. You can then order again.
Article 5. Delivery
5.1 We deliver to the delivery address you enter when ordering, within the European Union. At the start of the ordering process you can see which countries we deliver to and what the shipping costs are.
5.2 We ship your order within 1 working day of receiving payment, with PostNL. The delivery time is normally 1 to 3 working days in the Netherlands and 3 to 7 working days in other EU countries. The delivery time stated when ordering is an expectation. If, unexpectedly, delivery is not possible within that time, we let you know. The product must reach you no later than 30 days after the order. If it does not, you may give us a reasonable additional period to deliver and, if that period also expires, terminate the contract. We then refund everything you paid within 14 days.
5.3 The risk of damage or loss passes to you at the moment the product is delivered to you, or to someone you have designated for this. Until then the risk is ours.
5.4 If a shipment is returned as undeliverable because the address given is incorrect or the parcel was not collected, we contact you. For a second shipment we may charge the actual shipping costs.
Article 6. Right of withdrawal (cooling-off period)
6.1 As a consumer you may withdraw from the purchase without giving a reason within 14 days of the day on which you, or a person designated by you, received the product. If you bought several devices in one order that are delivered separately, the period starts on the day you receive the last device.
6.2 You withdraw by sending us a clear statement within that period, by email to support@airteq.eu or by post. You may use the model form attached to these terms, but you do not have to. We confirm your withdrawal by email.
6.3 During the cooling-off period you handle the product and the packaging with care. You may unpack the device, connect it and try it out as you would be allowed to in a shop, to judge whether it is what you expected. If you use the product more than is necessary for that, we may deduct the resulting loss in value from the amount we refund.
6.4 You return the product to us as soon as possible, and in any case within 14 days of your withdrawal, to the address in article 1.2, complete with adapter, cable and stand and preferably in the original packaging. The cost of returning it is yours; for a parcel from the Netherlands that is about 7 euros, from other EU countries about 15 to 25 euros. Use sound packaging and keep the proof of postage; until the parcel reaches us, the risk of the return shipment remains with you.
6.5 We refund everything you paid, including any delivery costs for the outbound shipment, within 14 days of your withdrawal. We may withhold the refund until we have received the product or until you have shown that you have sent it, whichever is earlier. We refund using the same payment method you used to pay, unless you agree to something else.
6.6 The right of withdrawal does not apply to business customers (article 17).
Article 7. What you may expect from the product (conformity)
7.1 The product must conform to what you may reasonably expect on the basis of the contract, the product description and the specifications. That is your statutory right as a consumer and that right is not limited by our warranty (article 8).
7.2 If the product does not conform, you are entitled to free repair or replacement within a reasonable time and without significant inconvenience. If that is not possible or not done in time, you may ask for a price reduction or terminate the contract, unless the defect is minor.
7.3 Report a defect as soon as possible after you discover it, preferably within two months. Describe what is wrong and, if you can, include a photo or video. Then we can act quickly.
7.4 If within twelve months of delivery it becomes apparent that the product does not conform to the contract, it is legally presumed that this was already the case at delivery, unless that presumption is incompatible with the nature of the product or of the defect.
Article 8. 24-month warranty
8.1 AirTeq B.V., Pascalweg 2a, 4104 BG Culemborg, the Netherlands, gives a 24-month warranty on the Canairy Home and the Canairy Home Plus from the date of delivery. This warranty applies in addition to, and does not affect, your statutory rights under article 7.
8.2 The warranty means that we repair, free of charge, or replace with an equivalent device, a device that within the warranty period does not work as it should because of a material or manufacturing defect. We choose between repair and replacement; in case of doubt we replace. A replacement device is covered by the remaining warranty period of the original device.
8.3 This is how it works: you report the problem to support@airteq.eu with your order number and a description. We respond within 2 working days. Often we solve it remotely. If not, you send the device to us; we send you a shipping label for this, so that shipping under warranty is at our expense. We aim to return the repaired or replacement device within 5 working days of receipt.
8.4 The warranty does not cover defects caused by: - use that deviates from the manual, such as use outdoors, in damp or condensing rooms or outside the stated operating conditions (0 to 50 °C, 0 to 90 percent humidity, non-condensing); - damage from dropping, impact or water, or damage caused by an adapter other than the supplied or an equivalent 5 V adapter; - opening the housing or repair by anyone other than AirTeq; - normal wear, such as slight discolouration of the housing or the screen.
8.5 For a complaint outside the warranty or outside statutory conformity, we first give you a quote for repair or replacement. You then decide whether to accept it.
Article 9. Use of the product
9.1 The Canairy is an aid to make the indoor climate visible and to support ventilation behaviour. It is not a medical device, not a safety device and not a substitute for a smoke detector, carbon monoxide detector or other legally required detection or measuring equipment. If in doubt about your health or safety, always take measures yourself and consult an expert.
9.2 The measuring accuracy is stated in the specifications. The device measures the air at the place where it stands; placement, draughts, sunlight and nearby heat sources affect the reading. The manual explains how to place the device.
9.3 You set the thresholds at which the colour changes yourself. The factory settings are a common starting point, not a standard determined for your situation.
Article 10. Outdoor values via Wi-Fi (Home Plus)
10.1 The Canairy Home Plus can show the current outdoor fine dust concentration and the pollen forecast. This requires your own Wi-Fi connection and the postcode you enter on the device yourself. Measuring indoors also works without Wi-Fi.
10.2 The outdoor values come from public third-party sources, currently the Dutch national air quality monitoring network (RIVM Luchtmeetnet) and Open-Meteo. We have no influence on the content, timeliness or availability of those sources. If a source disappears or changes, we make an effort to provide an equivalent source.
10.3 When outdoor values are retrieved, your postcode and the IP address of your connection become visible to the party supplying the data. Your own readings never leave the device. More about this is in our privacy statement at www.aircheq.com/en/privacy.html.
Article 11. Data and privacy
11.1 To carry out your order we process your name, address, email address and the payment status, and we produce an invoice that we keep for seven years. How we handle this is set out in the privacy statement at www.aircheq.com/en/privacy.html.
11.2 The Canairy’s measurement data stays on the device. We have no access to it and do not store it anywhere.
Article 12. Software and updates
12.1 The software on the device (firmware) is and remains the property of AirTeq. You receive the right to use that software as part of the device. You may not copy, modify or use the software separately from the device, except where the law expressly permits it.
12.2 The Canairy runs on fixed software and does not need updates in normal use. We do not release updates to add or change functions, and you cannot claim any.
12.3 If the software turns out to contain an error or a security problem as a result of which the device no longer conforms to what you may expect under the contract, we provide a solution: an update that the device retrieves via Wi-Fi, or repair or replacement of the device in accordance with articles 7 and 8. We do this for the period you may reasonably expect and in any case for 24 months after delivery. If we offer an update and you do not install it, the consequences are yours, provided we have told you what happens if you do not install the update.
Article 13. Liability
13.1 We are liable for damage you suffer because we fail to perform the contract, to the extent provided by law. We never exclude or limit our liability for death, personal injury or damage caused by intent or deliberate recklessness. Your rights under statutory product liability also remain fully intact.
13.2 We are not liable for damage resulting from use contrary to the manual or article 9, from thresholds you have set yourself, or from decisions you take on the basis of the values shown, unless that damage is attributable to us.
13.3 We are not liable for the accuracy or availability of third-party outdoor values as referred to in article 10, except to the extent that we ourselves fail in connecting those sources.
13.4 To the extent that our liability towards consumers may legally be limited, it is limited to twice the amount you paid for the order, per event. This limitation does not apply in the cases of article 13.1.
Article 14. Complaints
14.1 If you have a complaint about the product, the delivery or our service, email support@airteq.eu or call +31 (0)345 785 611. You can also open a ticket at support.airteq.eu. Describe the complaint as clearly as possible and quote your order number.
14.2 We acknowledge your complaint within 2 working days and respond substantively within 14 days. If we need more time, we let you know within those 14 days when you can expect an answer.
14.3 If we cannot resolve it together, you may submit the dispute to the competent court (article 18). AirTeq is not affiliated with a dispute resolution board. Consumers in the EU may also use the European Commission’s online dispute resolution platform at ec.europa.eu/odr.
Article 15. Discarded equipment
15.1 The Canairy is electrical equipment and does not belong with household waste at the end of its life. You can hand in the device free of charge at a municipal recycling centre or at a shop that sells similar equipment.
15.2 If you buy a new Canairy, you can return an old, similar device to us free of charge. Contact support@airteq.eu for this; we then arrange the collection.
Article 16. Force majeure
16.1 If, because of force majeure, we cannot deliver, cannot deliver on time or cannot deliver properly, we may suspend delivery for as long as the force majeure lasts. By force majeure we mean circumstances beyond our control, such as disruptions at carriers or payment service providers, power or internet failures, failure of component suppliers, fire, natural disasters, epidemics and government measures.
16.2 If the force majeure lasts longer than 30 days, both you and we may terminate the contract for the part not yet performed. Amounts already paid for that part are refunded within 14 days. As a consumer you also retain your rights under article 5.2.
Article 17. Business orders
This article applies if you order on behalf of a company, institution or association, or in the course of a profession. In that case the other articles apply, with the following deviations.
17.1 The right of withdrawal (article 6) and the other provisions that apply to consumers only do not apply. Orders cannot be cancelled after payment.
17.2 You check the shipment immediately upon receipt. Visible defects and discrepancies in quantities must be reported in writing within 8 days of receipt; other defects within 8 days of discovery and at the latest within the warranty period. After that period the delivery is deemed accepted. Article 7.4 (presumption of proof) does not apply.
17.3 The warranty of article 8 also applies to business customers, as a carry-in warranty. Outside the warranty our regular replacement and support arrangements apply.
17.4 The delivered devices remain our property until you have paid everything you owe us under the contract. For orders in the web shop this is the case as soon as the payment via Mollie has been received.
17.5 Our liability is limited to direct damage and to a maximum of the amount you paid for the order concerned. We are not liable for indirect damage, including consequential damage, lost profit, missed savings, business interruption, loss of data and damage caused by decisions taken on the basis of measured values. These limitations do not apply in the event of intent or deliberate recklessness on the part of our management.
17.6 You indemnify us against claims by third parties, including your own employees, visitors and customers, relating to the use of the devices or to decisions taken on the basis of the values shown.
17.7 You may not resell the devices as a trader without our prior written consent. Devices from the web shop are stand-alone consumer models and cannot be connected to the AirTeq dashboard or to LoRaWAN; separate business models exist for that, supplied on the basis of a quote. Those business models and the related services are governed by the NLdigital Terms, not by these web shop terms.
17.8 Purchasing or other conditions of the customer do not apply.
17.9 All claims against us become time-barred twelve months after they arise.
Article 18. Applicable law and disputes
18.1 The contract is governed by Dutch law. The Vienna Sales Convention (CISG) is excluded. If you are a consumer and live in another country of the European Union, you also retain the protection of the mandatory consumer rules of that country.
18.2 Disputes are submitted to the competent court in the Netherlands. For consumers this is the court that has jurisdiction by law. For business customers the District Court of Midden-Nederland, location Utrecht, has exclusive jurisdiction, unless we choose to submit the dispute to the court that has jurisdiction by law.
18.3 We always try to resolve a dispute together first, through the complaints procedure of article 14.
Article 19. Changes
19.1 We may change these terms. An order is governed by the version that was in the web shop at the time of ordering and that you received with the confirmation.
19.2 In the event of any conflict between these terms and a translation, the Dutch text prevails.
